These Terms of Service ("Terms") govern your access to and use of NovaStack products, services, and this website. By using any NovaStack service, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using any NovaStack product or service, you confirm that you are at least 18 years old, have the authority to enter into these Terms, and agree to comply with them. If you are using our services on behalf of an organisation, you agree to these Terms on behalf of that organisation.
2. Services
NovaStack provides software products and custom development services. We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of services.
3. Acceptable Use
You agree not to misuse our services. Prohibited activities include: attempting to gain unauthorised access to our systems, using our services for illegal purposes, distributing malware or harmful code, scraping or harvesting data without permission, and impersonating NovaStack or its representatives.
4. Intellectual Property
All content, software, and technology on this website and within our products — including code, designs, trademarks, and documentation — are the exclusive property of NovaStack. You may not copy, reproduce, or distribute any part of our intellectual property without written permission.
5. Payment & Refunds
Pricing for custom development projects and product licences is agreed upon in writing before work begins. Payments are non-refundable unless otherwise stated in a specific service agreement. For subscription-based products, refund eligibility is outlined in the individual product agreement.
6. Limitation of Liability
NovaStack is not liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
7. Disclaimer of Warranties
Our services are provided "as is" without warranty of any kind. We do not warrant that services will be uninterrupted, error-free, or meet your specific requirements. We disclaim all warranties, express or implied, to the maximum extent permitted by law.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Saudi Arabia.
9. Changes to Terms
We may revise these Terms from time to time. The "last updated" date reflects the latest revision. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms.
